Velko

Terms of Service

Last updated 17 October 2026

These terms are the agreement between you and Velko when you use the app to rent gear or lend it. They also set out what renters and owners agree with each other. Please read them; you accept them in the app before you start, and again whenever they change.

1. Who we are and what Velko is

Velko is a marketplace operated by David Miguel Ferreira Unip. Lda (NIPC 516583166), registered at Rua das Escolas 26, 3840-065 Calvão, Portugal (“Velko”, “we”). You can reach us athey@davidferreira.dev. This address is also our single point of contact for users and for authorities under the EU Digital Services Act; we answer in English and Portuguese.

Velko lets riders, schools and shops (“owners”) offer kitesurf, surf, wing foil and SUP equipment for rent, and lets other people (“renters”) book it. Velko provides the app, takes payments through Stripe, holds deposits under the procedure in section 8, and keeps the record of each rental. Velko does not own, inspect or supply the gear, and is not a party to the rental itself: the rental is a contract between the renter and the owner.

2. Private and business owners

Every listing shows whether the owner is a private individual or abusiness (a “trader”), as the owner has declared.

Owners who rent out gear as part of a trade, business or profession must register as a business. Before their listings go live, business owners give Velko their legal name, address, phone and trade register number, and certify that they comply with applicable EU law. Velko makes reasonable efforts to check this information (Digital Services Act, Art. 30).

3. Your account

4. Listing gear

Seller details and tax reporting

Before you can lend, you give Velko your seller details: your legal name, date of birth (private owners), tax identification number (NIF) and the country that issued it, address and phone, and, for businesses, your trade register number. Under Council Directive (EU) 2021/514 (“DAC7”) and Decree-Law 41/2023, Velko must collect these details, report the income owners earn through it to the Portuguese Tax Authority (Autoridade Tributária e Aduaneira, AT) once a year where DAC7 applies, and give each owner a copy of what was reported. These details are never shown to other users.

5. Booking

A renter chooses dates and sends a booking request. Their card is authorised for the rental price when they request, but not charged. The owner then has 72 hours to accept or decline. If the owner accepts, the rental price is charged and the booking is confirmed. If the owner declines, or doesn't answer in time, the authorisation is released and nothing is charged.

Before paying, the renter confirms that they have the skill and experience for the gear and the conditions, that they will check the gear before use, and that they will follow local rules. The confirmation is recorded with the booking.

Each rental is for specific dates, so the 14-day right of withdrawal for distance contracts doesn't apply to it (Decree-Law 24/2014, art. 17(1)(l), which excludes leisure services for a specific date or period). You can cancel under section 9 instead.

6. Prices, fees and payouts

7. How listings are shown, and reviews

Search shows active listings in the area you choose that are available for your dates and match the sport and any filters you set, newest first. Nobody can pay to be shown higher, and Velko doesn't rank its own interests above anyone's. Ratings show the average of verified reviews: only the renter and the owner of a completed rental can review each other, once, within 60 days of the rental ending. Velko doesn't edit reviews, and removes them only when they break section 12.

8. Deposits

9. Cancellations

10. Pickup, return and the condition record

11. Damage claims and disputes

If gear comes back damaged, with parts missing, or isn't returned, the owner can open a claim in the app before confirming the return, stating what happened and how much of the deposit they ask for, with photos unless the gear wasn't returned. The renter then has 48 hours to accept or dispute it; nothing is charged in the meantime. If the renter accepts, that amount is taken from the deposit hold and paid to the owner, and the rest is released.

If the renter disputes the claim or doesn't answer in time, the hold stays in place while a Velko reviewer looks at the rental record: pickup and return photos and whether both people agreed to them, pickup problem reports, messages, and anything either person sends in within the time we give. Normal wear and tear and faults recorded at pickup are not charged to the renter, and amounts are based on reasonable repair cost or the fair value of the item at the time of the rental, not its replacement cost when new. Velko then decides how much of the deposit, if any, goes to the owner, never more than the owner asked for, releases the rest, and tells you both why.

Appeal. Either of you can ask for the decision to be reviewed by replying within 14 days with new information. The review is done by someone not involved in the first decision.

Velko's decision settles only what happens to the deposit; it doesn't decide who is legally liable. Damage beyond the deposit, injury and any other claim are between the renter and the owner, and either of you keeps every right to take them to a Julgado de Paz, an arbitration centre or the courts (section 18). On request, Velko will share the rental record with both of you and with the court.

12. How to behave

13. Reporting illegal content, moderation and appeals

14. Safety and your responsibility

Water sports are dangerous and can cause serious injury. Renters are responsible for judging whether gear, conditions and their own ability are suitable, for checking the gear before use, and for using it within their skill level and local rules. Owners are responsible for the safety and condition of what they lend, and for disclosing known defects. Velko doesn't check gear, people or spots, and doesn't provide insurance. We recommend that owners insure valuable gear for rental use, and that renters have personal accident and liability cover.

15. Liability

16. Ending your use

You can stop using Velko and delete your account whenever you like, once you have no rental in progress. Velko may suspend or close accounts that break these terms or the law, as described in section 13.

For schools and shops lending as a business, Velko gives at least 30 days' notice, with reasons, before ending their access for good, except for a serious or repeated breach of these terms, a legal obligation, or a safety risk (Regulation (EU) 2019/1150, art. 4). Business owners can raise any complaint about Velko by email, and Velko answers within 15 days.

17. Changes and law

If these terms change, the new version is published here and announced in the app at least 15 days before it applies, unless a law or a safety issue requires a change sooner. For business users, this notice is always at least 15 days, as Regulation (EU) 2019/1150 requires. You'll be asked to accept the new version in the app; if you don't want to, you can close your account before it applies. These terms are governed by Portuguese law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and can bring a claim there.

18. Complaints and dispute resolution
